Niche FX Terms of Service

These Terms of Service apply to purchases made from the Niche FX online store. By accessing this website or purchasing a product, you agree to these terms.

1. Digital products

Niche FX supplies downloadable digital content, including facade reference images, visual starting images and other projection-mapping content.

No physical product will be delivered unless a product page specifically states otherwise.

Each product page explains what is included. Customers should review the product description, file format and intended use before purchasing.

2. Digital delivery

Digital products are normally made available after successful payment.

A download link may be displayed on the order-confirmation page and sent to the email address supplied during checkout.

Customers are responsible for providing a valid email address and securely backing up purchased files.

3. Licence to use purchased content

Unless a product page states otherwise, purchasing a Niche FX product gives the customer a non-exclusive, non-transferable licence to:

• Download and retain the purchased file
• Use the file as a starting image, visual prompt or creative reference
• Use the file within their own projection-mapping, image-generation or animation projects
• Display completed work created from the purchased file for personal or client-facing presentations

The original purchased file must not be:

• Resold or redistributed as a standalone product
• Shared publicly as a downloadable source file
• Uploaded to stock-image, template or asset libraries
• Sublicensed, transferred or given away to another person
• Included in another downloadable product pack
• Presented as an original source image created entirely by the customer

A separate licence may be required where a product page offers different home, professional or commercial usage options.

4. Customer-created results

Niche FX does not guarantee that a particular AI platform, image generator, animation service or projection-mapping application will produce a specific result.

Customers are responsible for checking the rules, terms and technical requirements of any third-party software or service they use.

5. Product compatibility

Product pages state the file format and the content supplied.

Customers are responsible for checking that their equipment and software can open and use the stated file type. Contact Niche FX before purchasing when compatibility is uncertain.

6. Prices and payment

Prices are displayed in pounds sterling unless stated otherwise.

Payment must be completed through the payment methods offered during checkout. An order is not complete until payment has been successfully authorised.

7. Refunds and faulty files

Digital purchases are subject to the Niche FX Digital Refund Policy.

Nothing in these terms removes or limits a customer’s statutory rights. Digital content supplied to UK consumers must be of satisfactory quality, fit for an agreed purpose and as described.

Please contact Niche FX promptly if a download link fails, an incorrect file is supplied, or the downloaded file is corrupt.

8. Intellectual property

Unless stated otherwise, the website design, product images, descriptions, branding and downloadable Niche FX files remain the intellectual property of their respective owner.

Purchasing a product grants permission to use it under the applicable licence. It does not transfer ownership of the underlying intellectual property.

9. Prohibited use

The website and products must not be used:

• For unlawful or fraudulent purposes
• To distribute malware or harmful files
• To misrepresent the source or ownership of purchased content
• To infringe another person’s copyright, trade mark, privacy or other rights
• In a way that breaches the terms of a third-party AI or software platform

10. Availability and changes

Niche FX may update, replace or discontinue products and website features.

Where an existing purchased file is updated, Niche FX may provide customers with access to the revised version, but ongoing access to future versions is not guaranteed unless explicitly included in the product description.

11. Limitation of liability

Nothing in these terms excludes liability where doing so would be unlawful.

To the fullest extent permitted by law, Niche FX is not responsible for indirect losses arising from incompatible software, third-party service changes, failed AI generations, projector configuration or use outside the product’s stated purpose.

13. Governing law

These terms are governed by the laws applicable in the United Kingdom. Customers may also have mandatory consumer rights based on their country of residence.
